Senate bill 404 will also permit licencees to operate historical horse racing machines, as well as establishing several funds for the Kansas horse racing community such as the Kansas horse council fund and privilege fee repayment fund.

The historical horse racing machines allow for players to bet on past horse races, presented in a format similar to a slot machine.

Having been introduced to the Senate and referred to the Committee on Federal and State Affairs, the bill will be discussed at the Senate hearing on 2 February.

Kansas still awaits the passing and implementation of sports betting legislation.

A bill Senate Bill 84 was first introduced in January 2021, before being passed by the Senate by a vote of 26-12. However, it was never passed by the House.
